Will Smith Road Incident and Death
On April 9, 2016, Cardell Hayes, 28, was operating a Hummer when Smith’s Mercedes SUV rear-ended it. This was the culmination of a long-running collision that allegedly started with Smith’s vehicle rear-ending the Hummer. The final collision caused Haye’s car to slam into the car in front of him and was severe enough to crack the Mercedes’ back glass.
Smith’s vehicle had been struck by Hayes’ vehicle in New Orleans’ Lower Garden District minutes earlier and less than two traffic lights distant. Smith, his better half Racquel, and two unidentified passengers were all in the same car as Smith.
In the aftermath, after exchanging words, Smith and Hayes shot each other with a handgun, killing Smith and injuring his partner.
During the inspection, a 9-millimeter handgun with all of its rounds loaded was discovered in Smith’s car. Hayes and a passenger in his car ensured their own survival. The New Orleans Police Department charged Hayes with second-degree murder following an investigation.
According to the findings of a posthumous toxicology analysis, Smith had a blood alcohol level of.235 the night of the incident, which is over twice the legal limit in Louisiana. Smith received protection on April 16, 2016.
On December 5, 2016, the preliminary hearing began in Orleans Parish Criminal District Court. On December 11, a jury in Orleans Parish found Cardell Hayes guilty of attempted murder of Will Smith’s better half, Racquel Smith, and homicide in the shooting death of Hayes.
Hayes was sentenced to 25 years in prison for homicide and 15 years for attempted murder on April 20, 2017, to be served concurrently. An adjudicator ruled down Hayes’ motion for another preliminary on April 19, the day before the sentence, but that decision was overturned on November 19, 2020. The Supreme Court overturned Hayes’ conviction on January 11, 2021.
